Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Make a Point Ltd. (company no. 515382026), a company registered in Israel (“Make a Point,” “we,” “us”), for your use of makeapoint.ai and the Ms. Crystal service (the “Service”). By using the Service you agree to these Terms and to our Privacy Policy.

1. Eligibility and accounts

You must be at least 18 and able to enter a contract. If you use the Service for an organization, you confirm you are authorized to act for it. You sign in with your email address; keep your access secure and don't share your account. You're responsible for activity under your account.

2. The Service

The Service gives AI-generated feedback and rewrite suggestions to help you sharpen written messaging. It is a coaching and drafting aid — the output is suggestions, not a guarantee of any particular result, and not legal, financial, or professional advice.

3. Acceptable use

You agree not to:

  • Submit content you don't have the right to submit, or others' confidential information without permission.
  • Use the Service for anything unlawful, infringing, harmful, or abusive.
  • Attempt to reverse-engineer, scrape, overload, or disrupt the Service, or bypass its limits or security.
  • Use the Service or its output to build or train a competing product or model.
  • Resell or provide the Service to third parties except as we permit.

4. Your content and intellectual property

  • You keep ownership of the content you submit.
  • You grant us a limited, worldwide license to host, process, and display your content solely to provide and support the Service to you, as described in the Privacy Policy. We do not use your content to train AI models.
  • We and our licensors own the Service, the software, and the Ms. Crystal brand and materials. These Terms grant you no rights in them beyond using the Service.
  • If you send us ideas or suggestions about the Service, we may use them freely without obligation.
  • You may use the feedback and rewrites the Service produces for you.

5. Third-party services

The Service relies on providers such as Anthropic (AI), Supabase (database and authentication), Vercel (hosting), Resend (email), and Deepgram (audio transcription). Your use may also be subject to their terms. We are not responsible for third-party services we don't control.

6. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that its output will be accurate or fit for a particular purpose. You are responsible for reviewing and deciding how to use any output.

7. Limitation of liability

To the fullest extent permitted by law, Make a Point will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the greater of the amounts you paid us for the Service in the 12 months before the claim, or USD 100.

8. Indemnity

You agree to indemnify Make a Point against claims arising from your content or your misuse of the Service, to the extent permitted by law.

9. Suspension and termination

You may stop using the Service and request deletion of your account at any time by emailing support@makeapoint.ai. We may suspend or end access if you breach these Terms or to protect the Service or its users. Sections that by nature should survive (ownership, disclaimers, liability, governing law) survive termination.

10. Changes

We may update the Service and these Terms. For material changes to the Terms we will post the updated version with a new date and take reasonable steps to notify you. Continued use after changes means you accept them.

11. Governing law

These Terms are governed by the laws of the State of Israel, and the competent courts of Tel Aviv-Jaffa will have exclusive jurisdiction, without regard to conflict-of-laws rules.
